General terms and conditions

Article 1 – Definitions
In these terms and conditions the following terms shall have the following meanings:
- Entrepreneur: Ibicello Netherlands BV, located at Voorweg 36, 1969 ME Heemskerk, registered with the Chamber of Commerce under number 95673148.
- Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.
- Distance contract: an agreement whereby, within the framework of a system organised by the entrepreneur for the distance sale of products, up to and including the conclusion of the agreement, exclusive use is made of one or more techniques for distance communication.
- Cooling-off period: the period within which the consumer can make use of his right of withdrawal.
- Right of withdrawal: the option for the consumer to cancel the distance contract within the cooling-off period.
Article 2 – Applicability
- These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
- Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer.
Article 3 – The offer
- The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to enable the consumer to make a proper assessment of the offer.
- Obvious mistakes or obvious errors in the offer do not bind the entrepreneur.
Article 4 – The agreement
- Subject to the provisions of paragraph 4, the agreement is concluded at the time the consumer accepts the offer and meets the conditions set therein.
- If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of acceptance of the offer electronically.
- The entrepreneur shall take appropriate technical and organizational measures to secure the electronic transfer of data and shall ensure a secure web environment.
Article 5 – Right of withdrawal
- The consumer can cancel an agreement regarding the purchase of a product during a reflection period of 14 days without giving any reason.
- The cooling-off period starts on the day after the consumer receives the product.
- During the cooling-off period, the consumer will handle the product and its packaging with care.
- In order to exercise the right of withdrawal, the consumer must inform the entrepreneur by means of an unambiguous statement.
Article 6 – Obligations of the consumer during the cooling-off period
- During the cooling-off period, the consumer will handle the product and its packaging with care.
- The consumer is only liable for any diminished value of the product resulting from handling the product in a way that goes beyond what is permitted.
Article 7 – Exercise of the right of withdrawal by the consumer and costs thereof
- If the consumer exercises his right of withdrawal, he must report this to the entrepreneur within the cooling-off period.
- The consumer returns the product with all supplied accessories, unopened, undamaged and in original condition and packaging.
- The consumer shall bear the direct costs of returning the product.
Article 8 – Obligations of the entrepreneur in case of withdrawal
- The entrepreneur will reimburse all payments made by the consumer, including any delivery costs, without delay but within 14 days following the day on which the entrepreneur receives the goods back.
- The entrepreneur uses the same payment method for reimbursement that the consumer used.
Article 9 – Exclusion of the right of withdrawal
- Products that spoil quickly or have a limited shelf life, as well as opened bottles of spirits, are excluded from the right of withdrawal.
Article 10 – The price
- During the period of validity stated in the offer, the prices of the products offered will not be increased, except for price changes due to changes in VAT rates.
- The prices stated in the product range include VAT.
Article 11 – Compliance with the agreement and additional warranty
- The entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer and the reasonable requirements of soundness and/or usability.
- An additional guarantee provided by the entrepreneur, his supplier, manufacturer or importer never limits the legal rights and claims that the consumer can assert against the entrepreneur under the agreement.
Article 12 – Delivery and execution
- The entrepreneur will take the greatest possible care when receiving and executing orders for products.
- The place of delivery is the address that the consumer has made known to the entrepreneur.
- Taking into account what is stated in article 4 of these general terms and conditions, the entrepreneur will execute accepted orders with due speed, but at the latest within 30 days.
Article 13 – Payment
- Unless otherwise specified in the agreement or additional conditions, amounts owed by the consumer must be paid immediately upon ordering.
Article 14 – Complaints procedure
- The entrepreneur has a sufficiently well-publicized complaints procedure and handles the complaint in accordance with this complaints procedure.
- Complaints about the performance of the agreement must be submitted to the entrepreneur fully and clearly described within a reasonable time after the consumer has discovered or could have discovered the defects.
Article 15 – Disputes
- Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.
- Disputes between the consumer and the entrepreneur regarding the conclusion or performance of agreements can be submitted to the competent court in the Netherlands.
Article 16 – Age verification and compliance with Alcohol Act
- The entrepreneur does not sell alcoholic beverages to persons under the age of 18.
- When placing an order, the consumer must confirm that he or she is 18 years or older.
- The entrepreneur reserves the right to verify the age of the recipient upon delivery.
Article 17 – Force Majeure
- In the event of force majeure, the entrepreneur is not obliged to fulfil his obligations.
- Force majeure means any circumstance beyond the control of the entrepreneur, which prevents the fulfillment of his obligations towards the consumer in whole or in part.
Article 18 – Additional or deviating provisions
- Additional or deviating provisions from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing.
